Important Facts about Abortion in New Mexico and Abortion Abuses
By Tara Shaver
You may be surprised to know that according to an article that ran in the Albuquerque Journal, New Mexico ranks “No. 1 in the nation for providing equal access to sexual and reproductive health services”…[ABORTION!]
New Mexico is the “Late Term Abortion Capital of the Country” and is the abortion capital of the Southwest. Every week, women come from all across the world to Albuquerque to obtain dangerous and risky late term abortions through all nine months of pregnancy.
New Mexico does not have any laws (BEING ENFORCED) restricting abortion whatsoever and it is one of 15 states that currently uses state tax dollars to fully fund abortions for women who have NM Medicaid. In 2011 alone 1,786 abortions were paid for in NM by Medicaid costing taxpayers over 1.1 million dollars.
New Mexico law criminalizes the practice of late term abortions that are performed outside of hospitals. However, this law is not being enforced, leaving women to suffer at the hands of unregulated abortionists. New Mexico is also one of 10 states that have no common sense laws such as parental notification, informed consent or any gestational restrictions on abortion. Abortion clinics in New Mexico are under regulated and the surgical portion of each clinic is not currently being inspected by the NM Health Department-EVER.
In 2011, light was shed on the fact that Albuquerque’s Sandia Foundation owns the land where late term abortion clinic Southwestern Women’s Options resides. The Foundation is directly helping to keep abortions in Albuquerque and is benefiting financially from the shedding of innocent blood.
In 2011-12, Tara Shaver filed Medical Board complaints against the abortionists’ at all three abortion clinics in Albuquerque including Planned Parenthood after uncovering a lawsuit filed against Planned Parenthood of NM. These complaints were based on fourteen 911 calls that documented serious abortion injuries. As a result, in November of 2012, late term abortionist Shelley Sella faced a Medical Board hearing after she violated the patient standard of care during a 35 week full term abortion in Albuquerque. Governor Martinez and Mayor Berry have been informed of these facts, yet abortion abuses still continue in Albuquerque.
The New Mexico Medical Board has most recently refused an investigation into a complication that took place at the Planned Parenthood surgical abortion center in Albuquerque.
The University of New Mexico runs its own free standing abortion clinic in Albuquerque. This clinic is being used to train Resident students to perform abortions up to 22 weeks gestation. At least three women have endured serious injuries at this clinic. Members of Protest ABQ have met with UNM Board of Regents to bring awareness to all of the Regents about UNM’s abortion agenda. The Dean of the UNM School of Medicine Paul Roth is also fully aware of the danger the UNM abortion clinic poses to the public. None of these men have made an effort to bring about change at UNM and women’s lives continue to be in danger.

Late-Term Abortion facility Southwestern Women's Options in Albuquerque is harvesting aborted baby body parts for medical research at The University of New Mexico.
In their 291-page letter to New Mexico Attorney General Hector Balderas, the House Select Panel on Infant Lives laid out a clear and convincing argument for criminal charges against the University of New Mexico (UNM) and a late-term abortion facility, Southwestern Women’s Options (SWWO), related to the acquisition of aborted baby remains.
Summary provided by Operation Rescue:
1. Two UNM abortionists created a radically pro-abortion climate at the “resistant” university and created a cultural shift that now aggressively promotes abortion.
2. Taxpayers partially fund UNM and SWWO’s abortion businesses.
3. The primary goal of UNM’s partnership with SWWO was to increase the volume of second trimester abortions, presumably to provide the UNM Health Sciences Center with an ample supply of aborted infant remains for “research” and other purposes. [Page 4]
4. SWWO is the sole provider of “aborted infant tissue” to the UNM Health Sciences Center (UNMHSC). [Page 8]
5. Whole brains from aborted babies were used for dissection by “summer camp” students.
6. UNM’s training agreement with SWWO violated UNM’s own policies and procedures on such contracts.
7. UNM granted faculty status to SWWO abortionists that included employee benefits that provided professional and financial benefit. These benefits may qualify as ‘valuable consideration.” [Pages 6-7]
8. New Mexico’s Spradling Act was violated. [Page 11]

Protest ABQ files formal criminal complaint with the New Mexico Attorney General, Hector Balderas based on SWWO consent form indicating their harvesting of aborted babies for medical research for UNM potentially violating New Mexico law:
In July 2015, Protest ABQ filed a formal criminal complaint with the Attorney General of New Mexico and two consent forms, one obtained by Pro-Life Witness from 2012 and a newly obtained consent form, which was obtained by Protest ABQ, this year 2015 from Southwestern Women’s Options (SWO) were submitted as proof of their using aborted baby body parts in medical research.
There are currently more questions for the NM Attorney General than answers and we hope that potential violations of New Mexico law would be of serious concern to his office.
-This facility’s own consent form mandates that women agree to the use of their babies bodies to be used for medical research.
-Has Curtis Boyd benefited financially by supplying fetal tissue to UNM?
-How can SWO transfer human tissue, classified as “infectious waste” under New Mexico law, without having to document or account for the disposal of such tissue?
-Is this tissue being transported outside the state to other academic institutions, and if so, is this a violation of 42 U.S.C. §289g-2 or other statutes?
-New Mexico has it’s own law on the matter that prohibits the selling of aborted baby body parts. The Jonathan Spradling Revised Uniform Anatomical Gift Act Section 24-6B-2 excludes aborted babies as decedents (section D.) who are capable of making an anatomical gift who can donate their organs and tissues for “transplantation, therapy, research or education.
-Protest ABQ’s criminal complaint has also asked the Attorney General to investigate whether UNM and SWO are in violation of New Mexico’s Maternal, Fetal and Infant Experimentation Act, NMSA § 24-9A-1, et seq.
-The Attorney General has a duty to uphold the laws of New Mexico and the United States, this issue is in his jurisdiction.
